旅客的人身伤亡或者自带行李、旅客车辆所载行李的灭失、损坏，是因船舶的沉没、碰撞、搁浅、爆炸、火灾或者船舶的缺陷引起的，承运人或者承运人的受雇人、代理人除非提出相反证据，应当视为其有过错。
